Your access to and use of LinguaBrowse is conditional upon your acceptance of and compliance with these Terms of Service. These Terms apply to all who install, access, open, or use LinguaBrowse.
By accessing or using LinguaBrowse, you agree to be bound by these Terms. You may not use, install, or access LinguaBrowse if you disagree with these Terms. This Terms of Service agreement is adapted from a Terms & Conditions agreement freely licensed to LinguaBrowse by TermsFeed.
LinguaBrowse uses third-party software, software packages, websites, and services for certain functionalities. LinguaBrowse also enables access to third-party Internet-delivered content.
We have no control over, and assume no responsibility for, the content, decency, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that We shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
We make no warranty that the purchases will meet your requirements, arrive in a timely fashion (as part of the purchase-handling process relies on Apple's App Store), be secure, mistake-free, or error-free. However, We will make reasonable efforts to ensure that purchased products fulfil their described purpose. Please contact Us with proof of purchase (ie. an invoice of the purchase from the App Store, emailed to Your email account) if an in-app purchase fails to be applied to your copy of LinguaBrowse.
LinguaBrowse's in-app purchases will provide only the functionalities described (to within the limitations specified in the previous paragraph) and no more. Purchase of a LinguaBrowse in-app purchase does not give the purchaser ownership of any part of LinguaBrowse.
Unless explicitly stated otherwise, LinguaBrowse in-app purchases will be linked to the account used to purchase it (eg. the Apple ID corresponding to the purchaser). If the in-app purchase is 'non-consumable' or a subscription, it may be transferred to other devices associated with the Apple ID as detailed in Apple's support page here (this support page also defines what a 'non-consumable' or 'subscription' purchase is.
We reserve the right to invalidate LinguaBrowse in-app purchases for future updates of LinguaBrowse if necessary (eg. due to the in-app purchase becoming redundant, or due to changing of LinguaBrowse's monetisation model, or major feature changes that might be incompatible with purchases made in previous versions), but will make reasonable efforts to maintain forward-compatibility of LinguaBrowse in-app purchases.
We do not provide any warranty that any LinguaBrowse in-app purchase may be refunded.
LinguaBrowse in-app purchases may be available for sale only in the marketplaces (eg. Apple's App Store) of certain regions. This may be due to differing policies or laws between countries.
LinguaBrowse requires a paid subscription, and subscriptions cannot currently be shared across platforms (i.e. mobile and desktop versions will require separate plans). Monthly and yearly subscription plans are offered, each including a fully-functional one-month trial. They are called "1-Month Plan (1-month trial)" and "12-Month Plan (1-month trial)" respectively, in English localisation; and may have corresponding translated names in other localisations. Pricing in other countries or territories may vary and charges may be converted to your local currency.
If you choose to purchase a subscription for LinguaBrowse, payment will be charged to your iTunes account, and your account will be charged for renewal 24 hours prior to the end of the current period; the charge will be as described by the product. Auto-renewal may be turned off at any time by going to your Account Settings in the iTunes Store after purchase.
After your LinguaBrowse free trial ends, your account will be charged unless your subscription is cancelled more than 24 hours before the end of your trial period. Any unused portion of a free trial period, if offered, will be forfeited upon subscription purchase.
This software is provided by Us "as is" and any express or implied warranties, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose are disclaimed. In no event shall We be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this software, including content generated by this software, even if advised of the possibility of such damage.
Unless explicitly stated otherwise (eg. in the Licenses document), the copyright and other intellectual property rights (eg. logo, visual design, source code, trademarks, concept, patents, etc.) in all parts of LinguaBrowse (in both its binary form and its source code), except for content belonging to third-party websites*, remain the property of Us (or otherwise the respective owner if explicitly stated). Materials in LinguaBrowse owned by Us may not be printed, copied, reproduced, republished, downloaded, posted, displayed, modified, reused, broadcast or transmitted in any way, except for Your own personal non-commercial use or with permission from Us.
* The content belonging to a third-party website can be discerned by comparing the content of a website in question with that as viewed in an independent web browser that does not modify the page (iOS Safari is the ideal browser for comparison). Modifications made to the page by LinguaBrowse (such as added transcriptions and token boundaries for text) belong to LinguaBrowse rather than the source website. The modifications made to the page by LinguaBrowse are done so in an automated manner and thus may not reflect Our views. We are not responsible for the accuracy, decency, or suitability of the content in any form of such modifications and they are provided only "as-is".
These Terms shall be governed and construed in accordance with the laws of United Kingdom, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
